Steps to take after a motor vehicle accident

1)  Don't admit fault --

Your perception of the event could easily be altered by your emotional state.  The facts may establish your perception to be wrong.  Further, if you are partly at fault, you may still have a claim.  In Ohio, fault can be apportioned and if you are less than 50% at fault, you may still receive compensation. This is called comparative negligence.

2)  Call the police and make a report--

Don't believe the driver who admits liability but doesn't want to call the police.  You will get burned.

3)  Seek medical attention, within 24 hours if possible.
4)  Take pictures of your injuries and of the damage to your vehicle.

It is important to document your injuries and damage in the event that settlment is not possible. Bruises and cuts heal quickly.  If you fail to photograph them when they occur, that evidence will be lost forever.

5)  Talk with a lawyer

If you are asked to sign any documents you don't understand, talk to a personal injury lawyer. Auto accident claims often involve issues that you are unfamiliar with, such as uninsured/underinsured coverage, medical payments coverage, comparative negligence and the like.  Having representation is the best way to make sure your rights are protected.
